Health care delivery models are rapidly changing in response to the COVID-19 pandemic. Due to State of Emergency declarations, providers that have historically focused on in-person care have been forced to explore the world of telehealth. Some have made this change quickly while others are still evaluating the implications telehealth will have on their practice. As providers, patients, and insurers continue to become comfortable with care delivered in this format, there is a debate about whether changes made to facilitate more expansive delivery of remote care will become permanent. Whether you are new to telehealth or an experienced telehealth provider, the reality is that the regulatory environment has dramatically shifted, raising many questions about what the future holds.

Jesse Berg counsels health care providers on Medicare and Medicaid reimbursement, enrollment and program integrity issues, compliance with the Stark Law, Anti-Kickback Statute and other federal and state fraud and abuse laws, HIPAA and state privacy and confidentiality matters, as well as antitrust issues. Jesse provides legal guidance to a variety of providers, including hospitals, physician groups, and ancillary service providers, such as clinical labs, imaging facilities, DME suppliers, and ambulatory surgery centers.

Randal L. Schultz

Partner, Lathrop GPM

Randal represents health care entities in all of their corporate structure, finance and governance needs and is involved with the design of ACO and clinically integrated networks. He works extensively with hospitals (private and governmental) and physician groups, as well as other for-profit and not-for-profit entities on their corporate and governance structure, contract matters, employee benefit issues, compensation planning issues and insurance program design and development.
