MN 2015 Legislative Session

The Governor and legislature resolved most of the budget during the regular legislative session, including Health and Human Services. They pushed changes with MinnesotaCare and MNsure off for another year to reach a consensus direction. Governor Mark Dayton called a special session in June to resolve the budgets in the following areas: jobs, energy, legacy, education finance, agriculture, environment and bonding. Ultimately, the Legislature reached agreement in these areas and the Governor signed them into law on June 13th, which will ensure the state is prepared for the July 1st beginning of the next state fiscal year. The approved state budget includes $250,000 for Honoring Choices Minnesota. Unfortunately, prior authorization reform was not passed by the legislature. MMA will continue its push in this area using cost and quality of care/access arguments. GAC recommends that MMGMA continue to support MMA’s efforts.

CMS Transitioning to New PQRS Portal through Enterprise Portal

The Centers for Medicare & Medicaid Services (CMS) announced that, on July 13, 2015, authorized users of the Individuals Authorized Access to CMS Computer Services (IACS) system will be transitioned to the existing Enterprise Identity Management (EIDM) system. The EIDM system will allow a single user ID to access the new “PQRS Portal” section of the existing CMS Enterprise Portal, which is the current system that serves such programs as the PQRS Group Practice Reporting Option, Medicare Shared Savings Program for Accountable Care Organizations, and Open Payments Program. To prepare for the transition, current IACS users will need to ensure their IACS account is active with a valid log-in while new users will need to register for an EIDM account. Following the switch, users will be able to submit data, access reports and perform administrative tasks under the new PQRS Portal section. MGMA will update members as CMS releases additional resources concerning this transition.

Minnesota Medical Association (MMA) Update on Medical Cannabis Program

For physicians interested in participating in the program, enrollment opened on June 1. A health care worker must certify that a patient has one of the nine qualifying conditions for them to participate in the Medical Cannabis program. Patients can then start purchasing the medication on July 1. Per MMA, Minnesota’s medical cannabis program is off to a cautious start. Only 104 physicians and providers registered for the program during the first week. And if a recent MMA survey is any indication, this slow start may continue. The survey showed that only nine percent of Minnesota physicians are planning to register for the program while 69 percent said they are not planning to participate. According to a recent Star Tribune article, “Patients search for MN physicians to enroll in Medical Cannabis,” many patients have been unable to find physicians and/or clinics willing to participate in the program.
MMA has developed a comprehensive Medical Cannabis Policies and Procedures Manual to help physicians and administrators find answers to their cannabis questions. The manual provides registration and certification information along with the policies and procedures that clinics need to prepare their staffs to confidently, consistently and legally manage patient questions and requests. Minnesota Health Care Programs Revalidation Requirements

Minnesota Health Care Programs (MHCP) announced revalidation changes for all provider types. Revalidation occurs every five years and MHCP will notify providers when they must revalidate their enrollment records. MHCP will now assess risk levels. Physicians and clinics are typically low risk but may be subject to unannounced site visits. There is an application fee of $553 per business location for institutional providers. Physicians and providers themselves are exempt from this fee; however, CMS defines an institutional provider to be any organizational provider that has a tax ID number or federal employer identification number. Government Affairs Committee

Now that the special session is completed, Government Affairs will turn our attention to relationship building with key legislators and commissioners. GAC also discussed whether to support prompt credentialing legislation mandating 90 days, which is a standard timeframe. South Dakota’s regulations require payers to credential providers retroactive to the application date. GAC will add this topic to legislative agenda for next year and begin working on a proposal with Messerli & Kramer. In addition, a MMGMA member will participate in the worker’s compensation task force this summer.

Membership Committee

Physicians can start to sign up in June for the Medical Marijuana program and patients can then be registered starting July 1. Please read MMA article above for more information.

Payer Relations Committee

The Fifth Annual Day with the Payers was a great success! It was a good opportunity to hear from our payer partners, learn about the 2015 legislative session, and network with colleagues.
